Acceptance of terms.

These Terms of Service ("Terms") govern your access to and use of Cyberify Catalog Export ("the App"), a Shopify embedded application operated by Cyberify ("we", "our", "us"), available at cyberify.net.

By installing the App from the Shopify App Store or continuing to use it, you ("Merchant", "you") agree to be bound by these Terms and our Privacy Policy. If you do not agree, do not install or use the App.

Description of service.

Cyberify Catalog Export is a product catalog app that:

• Connects to your Shopify store via the Shopify Admin API
• Reads your product catalog (titles, images, descriptions, prices, and variants) for display inside the app
• Lets you select products and export them as a CSV or JSON file, generated and downloaded directly in your browser

The App never modifies, updates, or deletes product data in your Shopify store — all product access is read-only.

Eligibility.

To use the App you must:

• Have an active Shopify store
• Be at least 18 years of age
• Have the legal authority to enter into agreements on behalf of your business

Account & access.

Shopify authentication

The App uses Shopify OAuth for authentication. You do not create a separate Cyberify Catalog Export account. Access is tied to your Shopify store and Shopify account credentials.

Account security

You are responsible for maintaining the security of your Shopify account. We are not liable for any loss or damage arising from unauthorised access to your account.

Acceptable use.

You agree to use the App only for lawful purposes and in accordance with these Terms. You must not:

• Attempt to circumvent, disable, or interfere with security features of the App
• Use the App to violate any applicable laws, regulations, or third-party rights
• Reverse engineer, decompile, or attempt to extract the source code of the App
• Use the App in any manner that could damage, disable, or impair our servers or networks

Shopify policies.

Your use of the App is also subject to the Shopify Partner Terms, which govern the App's distribution and API usage.

Data & privacy.

Our collection and use of your data is described in our Privacy Policy, which is incorporated into these Terms by reference.

By using the App, you grant us permission to access your Shopify store data (products, collections) as necessary to provide the App's functionality.

Intellectual property.

The App, including all software, design, content, and branding, is owned by Cyberify and protected by applicable intellectual property laws.

We grant you a limited, non-exclusive, non-transferable, revocable licence to use the App solely for your internal business purposes in accordance with these Terms.

You retain all rights to your store data and product information. You grant us a limited licence to process this data solely to provide the App's services.

Availability & uptime.

We aim to provide reliable, high-availability service. However, we do not guarantee uninterrupted access to the App. The App may be temporarily unavailable due to:

• Scheduled maintenance
• Unplanned technical issues
• Third-party service outages (Shopify, infrastructure providers)
• Events beyond our reasonable control

We will endeavour to communicate planned maintenance in advance where possible.

Disclaimers & liability.

Third-party dependency

The App relies on Shopify's API. We are not responsible for service degradation, data loss, or feature changes caused by this third-party platform.

Limitation of liability

To the maximum extent permitted by applicable law, Cyberify shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to loss of revenue, loss of profits, loss of data, or loss of business opportunity, arising out of or in connection with your use of the App.

Our total liability to you for any claims arising under these Terms shall not exceed the amounts paid by you (if any) in the twelve months preceding the claim.

"As is" service

The App is provided "as is" and "as available" without warranties of any kind, either express or implied, including but not limited to implied warranties of merchantability, fitness for a particular purpose, or non-infringement.

Indemnification.

You agree to indemnify, defend, and hold harmless Cyberify and its officers, directors, employees, and agents from and against any claims, liabilities, damages, losses, and expenses (including legal fees) arising out of or in connection with:

• Your use of the App
• Your violation of these Terms
• Your violation of any applicable law or third-party right
• Content or data you submit through the App

Termination.

By you

You may stop using the App and uninstall it from your Shopify store at any time. Uninstalling triggers automatic deletion of your data within 48 hours as described in our Privacy Policy.

By us

We reserve the right to suspend or terminate your access to the App at our sole discretion, with or without notice, if we reasonably believe you have violated these Terms or applicable law.

Effect of termination

Upon termination, your right to use the App ceases immediately. Sections of these Terms that by their nature should survive termination (including intellectual property, limitation of liability, and indemnification) will continue to apply.

Changes to these terms.

We may update these Terms from time to time. We will notify you of material changes by updating the "Last Updated" date at the top of this page and, where appropriate, by email or in-app notification.

Continued use of the App after changes are posted constitutes your acceptance of the updated Terms.

Governing law.

These Terms shall be governed by and construed in accordance with applicable law. Any disputes arising under these Terms shall be resolved through good-faith negotiation before any formal proceedings.
